Creditsafe data terms
These terms apply in respect of your use of the Services and in addition to the Fluidly Terms of Service (“Terms”). All capitalised terms herein shall have the meaning given to them in the Terms. In the event and to the extent of any inconsistency or conflict between the Terms and these additional terms, these additional terms shall take precedence.
If during the provision of the Services we identify any data to you, or any data is identifiable, as Creditsafe data or as originating from Creditsafe (“Creditsafe Data”), you shall, and shall procure that your Authorised Users shall:
1.1.1 not do (or suffer to be done) anything which may unfairly or unlawfully damage the reputation or integrity of Creditsafe or the Creditsafe Data;
1.1.2 not extract, modify, adapt, reutilise, use, exploit, redistribute, copy or store the Creditsafe Data for any purpose not contemplated by these Terms;
1.1.3 not download of or otherwise provide (in any form or by any means) in excess of 200,000 company records containing or comprising the Creditsafe Data (or any result or output derived therefrom);
1.1.4 not produce, license or create:
(a) a credit report or any product or service (in any form whatsoever) containing or referring to the Creditsafe Data (on its own or in combination with other data) or any results, output or materials derived from the Data which bears upon, refers to or otherwise relates to the creditworthiness of any given business or trading entity or otherwise competes with the Creditsafe’s credit reporting services; or
(b) a credit score/ risk indicator or credit limit or credit risk band;
1.1.5 use the Creditsafe Data at all times for internal use only in accordance with these Terms; and
1.1.6 not:
(a) include any Creditsafe Data in any product or service that you provide or sell to a third party; or
(b) sell, transfer, sublicense, distribute, commercially exploit or otherwise make available any Creditsafe Data or any output of materials derived from the Creditsafe Data to a third party,
except for using the Creditsafe Data to pre-fill product or service-related documentation.
1.1.7 not use any Creditsafe Data which relates to non-limited entities or sole traders to:
(a) compile a list of prospective businesses for the purpose of conducting telesales, telemarketing or direct email campaigns which are aimed at a target market and otherwise fall within a specific category/criterion; or
(b) build a telephone directory and/ or business directory.

Under no circumstances shall Creditsafe Business be held liable to you or your Authorised Users for any losses, damages, liabilities, claims, costs, actions or other expenses suffered or incurred as a result of the use or provision of the Creditsafe Data.
